The overtime rule (section 108)

Under section 108 of the Bangladesh Labour Act 2006, a worker who works beyond the fixed hours is paid at twice the ordinary rate of basic wage, dearness allowance and interim pay, if any. Workers paid by the piece are treated differently. The ordinary hourly wage is the monthly wage divided by 208 (26 working days × 8 hours). That is the divisor in the garment sector's wage notifications and at most employers.

The earned leave rule (section 117)

After a year of service an adult worker earns one day of paid leave for every 18 days worked. Unused leave carries over, and leave not taken is paid out when the job ends. Some sectors, such as tea estates and newspapers, count differently.

Maternity leave: 120 days

The 2026 amendment to the Labour Act raised maternity benefit from 112 to 120 days: 60 days before and 60 days after the birth, with pay.

Festival holidays: 13 days

The same amendment raised festival holidays from 11 to 13 days a year, with full pay. Working on a festival holiday earns a substitute day off and extra pay.

Why resignation pay and gratuity are not here

The 2026 amendment changed the tiers of compensation for workers who resign, and published summaries of it disagree. A missing figure is better than a wrong one, so this calculation will be added once checked against the gazetted text.

This is an estimate, not legal advice. If your appointment letter, company policy or contract gives more than the law, that applies. In a dispute, call the Department of Inspection for Factories and Establishments (DIFE) helpline 16357 or ask a labour lawyer.
